Both numbers are real, and both come from Notice CP59, the IRS letter that says it has no record of your tax return for a given year. 855-800-8106 is a fax line for sending Form 15103 if you believe you didn’t have to file. 800-829-8374 is the phone number the notice gives for questions.

What the IRS says happens if you don’t respond

The CP59 we reviewed lists three consequences:

  • “You may lose your claim to a refund or certain credits.” The tax code sets strict time limits for claiming them.
  • “We may determine your tax for you.” Penalties and interest can keep building on whatever the IRS decides you owe.
  • “You may become subject to backup withholding” on interest and dividends, meaning the IRS tells your bank or broker to hold back part of what it pays you.

Faxing Form 15103 to 855-800-8106

  1. Get Form 15103 at IRS.gov/F15103. The notice points you there.
  2. Check the box that fits your situation, then sign and date the form.
  3. Include the stub from the notice, or a copy of the notice, so the IRS can match the form to your account.
  4. Fax it with a regular fax machine or an online fax service. The notice asks you to understand your fax service’s privacy and security policies before you send.
  5. Keep the fax confirmation and a copy of everything you sent.

If you owe but can’t pay, file anyway

The penalty for filing late is much bigger than the penalty for paying late. Under Internal Revenue Code section 6651, the failure-to-file penalty is 5% of the unpaid tax for each month or part of a month the return is late, up to 25%. The failure-to-pay penalty is 0.5% a month. Filing now stops the bigger penalty from growing, and then you can set up a payment plan.
